Former Deputy Arrested For Child Pornography
The Texas attorney general's office announced Tuesday that a former Nacogdoches County sheriff's deputy, 32-year-old Michael Paul Kennedy, faces charges of receiving and transporting child pornography.

A federal grand jury in Beaumont indicted Kennedy last week. He was arrested Monday by the FBI and members of the attorney general's Cyber Crimes Unit and arraigned Tuesday, according to information from the AG's office.

Kennedy's name surfaced as part of an investigation of credit card holders who purchased access to a Web site that contained child pornography, the information said.

Images of child pornography were found on Kennedy's computer, according to a news release.

The Texas Rangers and U.S. Attorney for the Eastern District of Texas assisted in the investigation, the information said.

The case is part of Project Safe Childhood, a national initiative using task forces to stop the sexual exploitation of children online.

Former Officer Arrested For Sex Assault

A former Malakoff police officer has been arrested for allegedly sexually assaulting a woman after placing her into custody. Officials close to the case said the assault might not be the only one the officer committed while on duty.

Henderson County Sheriff's officials told the Tyler Morning Telegraph that Horace Anthony Poullard, 56, turned himself in to authorities shortly before 2 a.m. Tuesday morning and was soon released after posting a $5,000 bond.

"He turned himself in based on a grand jury indictment charging him with violation of a prisoner's civil rights," Lt. Pat McWilliams said Tuesday morning.

MULTIPLE INVESTIGATIONS

The indictment from the state came after a Texas Rangers' investigation, but FBI officials have told the newspaper they too are investigating the former lawman.

Special Agent Jeff Millslagle said FBI agents assisted in the state's investigation.

"We told the district attorney over in Henderson County to go ahead with the state charges, because it takes us longer to get a person charged on an investigation like this," he said. "But we are pursuing our own charges."

The investigations stemmed from an alleged incident on Feb. 11, sometime during Poullard's night shift when he somehow came in contact with the victim.

Malakoff City Administrator Glen Herriage said the city was informed of the allegations sometime in March after the victim told another agency.

"She didn't report it here, but in another city to another police department and they contacted us," he said.

He added the reported assault took place within the city limits in the officer's patrol car.

McWilliams and Millslagle said the woman was not arrested or charged with any crime on the date the incident is alleged to have occurred and jail records show she was not booked into jail.

A copy of the indictment obtained by the newspaper states grand jurors listening to evidence in the case found Poullard intentionally engaged in sexual contact with the victim while she was in custody and he was acting in the capacity of a sworn peace officer.

Millslagle did not know when his investigation would be complete or when charges would be leveled against the man in the federal system.

"We are investigating the incident and other allegations that we have been made aware of involving this officer," he said.

Herriage said the city's police department had investigated at least one other incident.

REGAINING TRUST

Herriage said the city of Malakoff was reeling from the allegations and trying to show the public the police force could be trusted.

"When something like this is reported it just undermines a police department whether small like ours or in a large city," he said.

Herriage said that when the city learned of the allegations Poullard was moved from night shift to day shift, but was not placed on leave.

"We moved him to the day shift so there would be more supervision while the investigation was ongoing, because it was an allegation," he said.

Herriage added that Poullard, who had only been with the agency 11 months, resigned from the department July 7.

Texas Commission on Law Enforcement Officer Standards and Education records indicate Poullard began working at the department in August 2006 and shows he has been a commissioned officer just more than three years.

"We hired (Poullard) during a rough time here in the city," Herriage said. "We have been having problems since a police chief died four years ago and Poullard was hired at a real critical point."

He added that the Elkhart Police Department in Anderson County, where the officer had worked in a reserve status, had recommended Poullard for the job.

"They said if they could have hired him they would have so we felt comfortable with our decision," he said.

When asked what he would say to the public to regain their trust toward the city's police officers, Herriage thought for several minutes and said "I can't answer that at this time."

"It is a difficult time for all of the departments in the city because we are so small," he said. "I just don't know what else to say."
